Is It Possible to Override a Registered Antenuptial Contract with a Postnuptial Agreement?

Before the Matrimonial Property Act 88 of 1984 (MPA) was introduced, matrimonial property law in South Africa was governed by... the immutability principle. This principle dictated that the property regime chosen by a couple at the time of their marriage could not be altered afterward. The case of Honey v Honey in 1992 (93 SA 609 (W)) reinforced this, stating that under common law, spouses couldn't modify their matrimonial property system through an agreement. Any contract attempting to change the prenuptial agreement was considered void and unenforceable. However, the introduction of the MPA softened this rigid stance by providing ways for couples to change their matrimonial property system after marriage.

The government introduced the Reconstruction and Development Programme (RDP) as its social housing programme to provide low-income families with sustainable housing. Despite the substantial commitment by the government, there have been cases of illegal sales and fraudulent activities related to state-funded houses. Exercise of Rights and Obligations under a Praedial Servitude

A servitude is a limited real right which entitles its holder either to the use and enjoyment of another person’s... property or to insist that such other person shall refrain from exercising certain entitlements following from his or her right of ownership over and in respect of his or her property which he or she would have if the servitude did not exist. Pertinent to this article is a praedial servitude which pertains to two pieces of land that are in close proximity to, or next to one another. A praedial servitude constitutes a burden imposed on one piece of land (servient owner) in favour of another piece of land (dominant owner).
